These Terms govern your access to and use of the Babue website and products.

1. Acceptance of Terms

By accessing the Site or purchasing Babue products, you agree to these Terms.

If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to purchase products.

3. Product Use & Safety

Babue carriers are designed for use within specified weight ranges and configurations.

By purchasing, you agree that:

• You will follow all safety instructions provided
• You will adhere to the T.I.C.K.S. safe babywearing guidelines
• You understand improper use may result in serious injury or death
• You will supervise your child at all times while using the product

Products must not be modified or altered. Misuse voids any warranty.

4. ASTM Compliance

Babue carriers are designed to meet ASTM F2236 requirements.

Compliance statements apply only to tested configurations.

5. Medical Disclaimer

Product design input from occupational therapy professionals is educational in nature. Nothing on the Site constitutes medical advice.

6. Pricing & Payment

• Prices are listed in USD unless otherwise stated.
• We reserve the right to correct pricing errors.
• Orders may be cancelled for suspected fraud.

7. Returns

We offer a 5-day return period from the date of delivery, subject to:

• Product being in original, unused condition with all packaging and tags
• Proof of purchase
• Compliance with our Refund & Return Policy

Returns are subject to a non-refundable $10 packaging and handling fee. Customers are responsible for all return shipping costs. Shipping fees from the original order may be non-refundable.

8. Warranty Disclaimer

To the maximum extent permitted by law:

Products are provided “AS IS” without warranties except those expressly stated.

We disclaim implied warranties of merchantability and fitness for a particular purpose, except where prohibited by law.

9. Limitation of Liability

To the maximum extent permitted by law:

Babue shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability shall not exceed the purchase price of the product giving rise to the claim.

Some jurisdictions do not allow limitation of liability, so certain limitations may not apply.

10. Indemnification

You agree to indemnify and hold Babue harmless from claims arising from:

• Improper product use
• Violation of these Terms
• Misrepresentation of product condition upon return

11. Intellectual Property

All trademarks, designs, logos, and proprietary strap systems are the exclusive property of Babue.

Unauthorized use is prohibited.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, excluding conflict of laws principles.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

13. Dispute Resolution

Disputes may be brought in the courts of Alberta, Canada, subject to applicable law. Nothing in these Terms prevents you from bringing issues to the attention of applicable regulators.
